本文为网上收集整理，如需要该文档得朋友，欢迎下载使用RegulationsontheControloverSafetyofDangerousChemicalsDecreeNo.344oftheStateCouncilofthePeople’sRepublicofChinaPromulgationDate:26thJanuary2002EffectiveDate:15thMarch2002Promulgatedby:TheStateCouncilChapterIGeneralPrinciplesArticle1Inordertostrengthenthecontroloversafetyofdangerouschemicals,toguaranteethepeople’slifeandpropertysafety,andtoprotecttheenvironment,theseRegulationsareherebyenacted.Article2Production,operation,storage,transportation,anduseofdangerouschemicalsanddisposalofthewasteddangerouschemicalswithintheterritoryofthePeople’sRepublicofChinashallbegovernedbytheseRegulations,lawsandotheradministrativeregulationsoftheStateonproductionsafety.Article3“Dangerouschemicals〞asreferredtohereinincludeexplosives,pressuregas,liquefiedgas,inflammableliquid,inflammablesolid,spontaneouscombustiblearticles,combustiblematerialsincaseofmoisture,oxidants,organicperoxide,toxicarticles,corrosives,etc.DangerouschemicalslistedontotheListofDangerousArticles(GB12268)promulgatedasthenationalstandard,thecatalogueofhyper-toxicchemicals,andotherdangerouschemicalsnotlistedontotheListofDangerousArticlesshallbedeterminedandannouncedbytheadministrativedepartmentinchargeofcomprehensivemanagementofeconomyandtradejointlywiththeadministrativedepartmentsinchargeofpublicsecurity,environmentalprotection,health,qualitycontrol,trafficcontrol,etcoftheStateCouncil.Article4Thepersonnelchieflyinchargeofunitsthatmanufacture,dealin,store,transport,andusethedangerouschemicalsanddisposeofthewasteddangerouschemicals(hereinafterreferredtoasthe“unitsofdangerouschemicals〞)mustguaranteethesafetycontrolfortheirowndangerous精品文档，word文档本文为网上收集整理，如需要该文档得朋友，欢迎下载使用chemicalssatisfyprovisionsoftherelevantlaws,regulations,andrules,aswellasrequirementsofthenationalstandards,andberesponsibleforthesafetyoftheirowndangerouschemicals.Thepersonnelengaginginthemanufacture,operation,storage,transportation,useofdangerouschemicalsordisposalofwasteddangerouschemicalsoftheunitsofdangerouschemicalsmusttakepartinthetrainingfortherelevantlaws,regulations,rules,safetyknowledge,professionalskills,vocationalsafetyprotection,andemergencyknowledge.Onlythosepassingtheexaminationmayholdtheirposts.Article5Therelevantdepartmentsinchargeofsupervisionandadministrationofthemanufacture,operation,storage,transportation,useofdangerouschemicals,andthedisposalofthewasteddangerouschemicalsshallfulfilltheirresponsibilitiesaccordingtothefollowingprovisions:(1)TheadministrativedepartmentinchargeofoverallmanagementofeconomyandtradeoftheStateCouncilandtheadministrativedepartmentsofeconomyandtradeofthepeople’sgovernmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralPeople’sGovernmentshall,inaccordancewiththeseRegulations,beresponsiblefortheoverallworkforthesupervisionandadministrationofsafetyofdangerouschemicals,beresponsibleforexaminationandapprovaloftheestablishment,reconstruction,andexpansionofenterprisesthatmanufactureorstoredangerouschemicals,beresponsiblefortheexaminationandappointmentoftheprofessionalmanufacturingenterprisesofpackingmaterialsorcontainers(includingtroughcontainersusedfortransportation,hereinafterinclusive),beresponsibleforissuanceofthelicensesforoperationofdangerouschemicals,beresponsibleforregistrationofdomesticdangerouschemicals,beresponsiblefororganizingandcoordinatingtheemergencyrescueforthedangerouschemicalaccidents,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.Theadministrativedepartmentinchargeoftheoverallworkforsupervisionandadministrationofsafetyofdangerouschemicalsofthepeople’sgovernmentsofmunicipalities(withdistricts)andthepeople’sgovernmentsatthecountylevelshallbedeterminedbythepeople’sgovernmentsatalllevels,andfulfilltheir精品文档，word文档本文为网上收集整理，如需要该文档得朋友，欢迎下载使用responsibilitiesinaccordancewiththeseRegulations.(2)Thepublicsecurityorgansshallberesponsibleforthepublicsecuritycontroloverdangerouschemicals,beresponsiblefortheissuanceofhyper-toxicchemicalpurchasecredenceandpurchaselicenses,beresponsibleforexamining,approving,andissuingroadtransportationpassesforhyper-toxicchemicals,beresponsibleforsupervisionoverthesafetyoftheroadtransportationofdangerouschemicals,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.(3)Theadministrativedepartmentsinchargeofqualitycontrolshallberesponsiblefortheissuanceofthemanufacturelicensesfordangerouschemicalsandtheirpackingmaterialsaswellascontainers,beresponsibleforthesupervisionoverthequalityofpackingmaterialsandcontainersofdangerouschemicals,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.(4)Theadministrativedepartmentsinchargeofenvironmentalprotectionshallberesponsibleforthesupervisionandadministrationofthedisposalofwasteddangerouschemicals,beresponsiblefortheinvestigationofseriousdangerouschemicalpollutionaccidentsandtheecologicaldamageincidents,beresponsiblefortheemergencymonitoringofthesitesoftoxicchemicalaccidentsandregistrationoftheimporteddangerouschemicals,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.(5)Theadministrativedepartmentsinchargeofrailwaysandcivilaviationshallberesponsiblefortherailwayandairtransportationofdangerouschemicals,andthesafetycontrol,supervision,andexaminationofrailwayandairtransportationunitsfordangerouschemicalsandtheirmeansoftransport.Theadministrativedepartmentsinchargeofcommunicationsshallberesponsibleforthesafetycontrolofthehighwayandwaterwaytransportationunitsfordangerouschemicalsandtheirmeansoftransport,andthesupervisionoversafetyinthewaterwaytransportationofdangerouschemicals,beresponsiblefordeterminingthe精品文档，word文档本文为网上收集整理，如需要该文档得朋友，欢迎下载使用professionallevelsofhighwayandwaterwaytransportationunitsfordangerouschemicals,drivers,shipmen,loadingandunloadingpersonnel,andtransportescorts,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.(6)Theadministrativedepartmentsinchargeofhealthshallberesponsiblefortheauthenticationoftoxicityofdangerouschemicals,andthemedicalrescueofthepersonnelwhodieorareinjuredduetoaccidentsofdangerouschemicals.(7)Theadministrationsforindustryandcommerceshall,inaccordancewiththeapprovalorlicensesoftherelevantdepartments,issuethebusinesslicensesforunitsthatmanufacture,dealin,store,ortransportdangerouschemicals,andsuperviseandadministerthebusinessoperationsinthedangerouschemicalmarket.(8)Theadministrativedepartmentsinchargeofpostshallberesponsibleforthesupervisionandexaminationofdangerouschemicalssentbypost.Article6TherelevantdepartmentsinchargeofsupervisionandadministrationofunitsofdangerouschemicalsinaccordancewiththeseRegulationsmayexercisethefollowingpowersinthecourseofsupervisionandexaminationaccordingtolaw:(1)Toenterintotheoperatingsitesofdangerouschemicalstomakethespotexamination,totransfertherelevantmaterials,andlearntherelevantinformationformthepersonnelconcerned,andtotabletheproposalsforunitsofdangerouschemicalstomakerectificationandimprovement;(2)Toorderthepartiesconcernedtoeliminatethehiddenrisksofaccidentsofdangerouschemicalsforthwithorwithinaspecifiedtimelimitwhensuchrisksarediscovered;(3)Toorderthepartiesconcernedtoceaseforthwiththeuseoffacilities,equipment,apparatus,andmeansoftransportthatfailstomeettherelevantlaws,regulations,rules,andnationalstandardsbasedonevidence;and精品文档，word文档本文为网上收集整理，如需要该文档得朋友，欢迎下载使用(4)Tomakecorrectionsonthespot,ortoorderthepartiesconcernedtomakecorrectionswhenfindingtheillegalacts.Unitsofdangerouschemicalsshallbesubjecttothesupervisionandexaminationconductedbytherelevantdepartmentsaccordingtolawwithoutrefusalorhindrance.Whenperformingtheirdutiesofsupervisionandexamination,thepersonnelassignedbytherelevantdepartmentsshallproducetheircertificates.ChapterIIManufacture,Storage,andUseofDangerousChemicalsArticle7TheStatecarriesouttheunifiedplanning,rationalarrangement,andstrictcontroloverthemanufactureandstorageofdangerouschemicals,andimplementsthesystemtoexamineandapprovethemanufactureandstorageofdangerouschemicals.WithoutexaminationandapprovaloftheState,anyunitsandindividualsshallnotmanufactureorstoragedangerouschemicals.Thepeople’sgovernmentsatthemunicipalitylevel(withdistrictsestablishedwithinthemunicipality)shall,accordingtothelocalactualdemandfortheeconomicdevelopment,allocatetheappropriateareastobespecializedforthemanufactureandstorageofdangerouschemicalsinaccordancewiththeprincipleofensuringsafetywhenmakingtheoverallplanning.Article8Anenterpriseformanufactureorstorageofdangerouschemicalsmustfulfillthefollowingqualifications:(1)Itshallhavethemanufacturetechniques,equipment,orwarehousingmeansandfacilitiesmeetingthenationalstandards;(2)ThedistanceofprotectionaroundfactoriesandwarehousesshallmeetthenationalstandardsortherelevantprovisionsoftheState;(3)Itshallhavethemanagementandtechnicalpersonnelsatisfyingthedemandformanufactureorstorage;(4)Itshallhavehealthysafetycontrolsystem;and(5)Itshallhavefullqualificationsasrequiredbylaws,regulations,andnationalstandards..精品文档，word文档本文为网上收集整理，如需要该文档得朋友，欢迎下载使用Article9Inordertoestablishanenterpriseforthemanufactureorstorageofhyper-toxicchemicals,andanenterpriseforthemanufactureorstorageofotherdangerouschemicals,theapplicationsshallbefiledtotheadministrativedepartmentinchargeofeconomyandtradeoftherelevantprovince,autonomousregion,ormunicipalitydirectlyundertheCentralPeople’sGovernmentandtheadministrativedepartmentinchargeoftheoverallworkofsupervisionandadministrationofsafetyindangerouschemicalsofthepeople’sgovernmentatthemunicipalitylevel(withdistricts)respectively,andsubmitthefollowingdocuments:(1)Thefeasibilityresearchreport;(2)Indicatorsofphysicalchemicalpropertiessuchasignitionpoint,spontaneouscombustionpoint,flashpoint,limitsofexplosion,toxicity,etc.ofrawmaterials,intermediaryproducts,finalproducts,orstoreddangerouschemicals;(3)Technicalrequirementsonthepacking,storage,andtransportation;(4)Asafetyevaluationreport;(5)Measuresemergencyrescue;and(6)ThesupportingdocumentsfulfillingconditionsofArticle8herein.Theadministrativedepartmentsinchargeofeconomyandtradeofthepeople’sgovernmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralPeople’sGovernment,ortheadministrativedepartmentsinchargeoftheoverallworkofsupervisionandadministrationofsafetyofdangerouschemicalsofthepeople’sgovernmentsatthemunicipalitylevel(withdistricts)shallorganizetherelevantexpertstoexaminetheapplicationsreceivedandthedocumentssubmitted,andshallreporttheexaminationopinionsoftheseexpertstothepeople’sgovernmentsatthesamelevelstomakedecisionsofapprovalordisapproval.Accordingthedecisionsofthepeople’sgovernments,theadministrativedepartmentsinchargeofeconomyandtradeofthepeople’sgovernmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralPeople’sGovernment,ortheadministrativedepartmentsinchargeoftheoverallworkofsupervisionandadministrationofsafetyofdangerouschemicalsofthepeople’sgovernmentsatthemunicipalitylevel(withdistricts)shallissuethedocumentsofapprovaltotheapprovedapplicant;otherwise,theyshallnotifythedisapprovedapplicantsinwriting.Theapprovedapplicantsshallgothroughtheregistrationformalitieswiththeadministrationsforindustryandcommercedependingonthedocumentsofapproval.Article10Exceptthefuelingstationsformeansoftransport,suchquantityoftheinstallationsmanufacturingandstoringdangerouschemicalsconstitutingtheserioushazardsourcesandthedistancefromthefollowingplacesandareasmustsatisfythenationalstandardsortherelevantprovisionsoftheState:精品文档，word文档本文为网上收集整理，如需要该文档得朋友，欢迎下载使用(1)Residentestates,commercialcenters,parks,andotherdenselyinhabiteddistricts;(2)Schools,hospitals,cinemas,stadiums,gymnasiums,andotherpublicfacilities;(3)Watersupplysources,waterplants,andwatersourceprotectionzones;(4)Stations,docks(excludingthosespecializedforloadingandunloadingofdangerouschemicalsuponapprovalaccordingtotherelevantprovisionsoftheState),airports,highways,railways,waterwaymainlines,windbooths,entrance,andexitofundergroundrailways;(5)Thebasicfarmlandprotectionzones,animalhusbandryzones,fishingwaters,andbasestoproduceseeds,breeders,andoffspringofaquaticproducts;(6)Rivers,lakes,placesofhistoricalinterestandscenicspots,andnaturalprotectionzones;(7)Prohibitedmilitaryzonesandmilitarycontrolzones;and(8)Otherareastobeprotectedbylawsandadministrativeregulations.Incasethatthequantityofinstallationsmanufacturingdangerouschemicalsthathavebeenbuilt,andthestoragefacilitiesthatconstitutetheserioushazardsourcesdoesnotfulfilltheprovisionsoftheprecedingParagraph,theadministrativedepartmentsinchargeoftheoverallworkforthesupervisionandadministrationofsafetyofdangerouschemicalsofthepeople’sgovernmentsatthemunicipalitylevel(withdistrictsestablishedwithinthemunicipality)shallsupervisethepartiesconcernedtomakerectificationandimprovementwithinthespecifiedtimelimit.Thechangeofthelineofproduction,thestoppageofproduction,themove,orshutdownshallbereportedtothepeople’sgovernmentsatthesamelevelsforapproval,andcarryoutsuchactivitiesuponapproval.“Serioushazardsources〞asreferredtohereinmeanscells(includingplacesandinstallations)inwhichthedangerouschemicalsaremanufactured,transported,used,orstored,orthewastedchemicalsaredisposedof,andthequantityofdangerouschemicalsisequaltoorexceedsthethresholdquantity.Article11ThereconstructionorexpansionofanenterpriseformanufactureorstorageofdangerouschemicalsmustbeexaminedandapprovedinaccordancewiththeprovisionsofArticle9herein.Article12AnenterprisetomanufacturedangerouschemicalsthatisestablishedaccordingtolawmustapplytotheadministrativedepartmentinchargeofqualitycontroloftheStateCouncilfordrawingthelicensefor精品文档，word文档本文为网上收集整理，如需要该文档得朋友，欢迎下载使用manufacturingdangerouschemicals;anyenterprisethatfailstoobtainsuchlicenseshallnotcommencethemanufactureofdangerouschemicals.TheadministrativedepartmentinchargeofqualitycontroloftheStateCouncilshallnotifytheadministrativedepartmentinchargeofcomprehensivemanagementofeconomyandtrade,theadministrativedepartmentinchargeofenvironmentalprotection,andthepublicsecurityorganoftheStateCouncilofthesituationabouttheissuanceoflicensesformanufacturingdangerouschemicals.Article13Anyunitsandindividualsshallnotmanufacture,dealin,orusedangerouschemicalsthatareprohibitedbytheState’spublicproclamation.Hyper-toxicchemicalsshallbeprohibitedfrommanufacturingraticidesandotherchemicalproductsandchemicalsforthedailyuse.Article14Whoevermanufacturesdangerouschemicalsshallattachthetechnicalspecificationsforthesafetyofchemicalsinfullaccordwithdangerouschemicalsinthepackingmaterialsofdangerouschemicals,andaffixorpostthesafetysignsforchemicalsinfullaccordwithdangerouschemicalsinthepackingmaterialsontheexternalpackagingmaterials.Whenfindingthatdangerouschemicalsmanufacturedhavethenewhazardcharacteristics,themanufacturingenterprisesofdangerouschemicalsshallmakethepublicannouncementsforthwith,andmodifythetechnicalspecificationsforsafetyandthesafetysignsintime.Article15TheproductionconductionsofunitsengaginginthemanufactureofdangerouschemicalsmustfulfillthenationalstandardsandtherelevantprovisionsoftheState,andtheseunitsshallobtainthecorrespondinglicensesinaccordancewiththerelevantlawsandregulationsoftheState,mustestablishandstrengthentheregulationsandruleson
